Please read these terms carefully before using The Five Books platform.
Last updated: January 1, 1970Anyone wishing to use this Service must agree to these Terms, register an account, and become a member using their registered account information. The Five Books may send emails to the member's registered address regarding lectures, related information, new features, updates, and other announcements. Members agree to receive such communications.
The Five Books makes no warranty that this Service is fit for any particular purpose of the member, has the expected commercial value, accuracy, or usefulness, that the member's use of the Service complies with applicable laws, or that the Service will be free from defects. Except in cases of intentional or gross negligence, The Five Books shall bear no liability for damages suffered by participants in connection with any interruption, suspension, termination, or modification of the Service, deletion of membership registrations, equipment failure or damage, or any other matter related to use of the Service. Participants shall, at their own cost and responsibility, prepare the devices, internet connection, software, and other equipment required to use the Service. The Five Books bears no liability for damages arising from internet connectivity issues or other unforeseen causes.
Participants shall manage and keep their passwords and accounts at their own responsibility, and shall not allow third parties to use them, or lend, transfer, change the name of, or sell them. Members shall bear responsibility for any damages resulting from inadequate management of their password or account, errors in use, or use by third parties. The Five Books bears no liability. If a member discovers that their password or account has been stolen or used by a third party, they shall immediately notify The Five Books and follow the operator's instructions.
All copyrights and other intellectual property rights in lecture materials and lecture recordings belong to the lecturer who delivered the lecture. The Five Books grants members the right to use lecture materials and recordings only to the extent necessary to use the Service in accordance with these Terms.
If The Five Books determines that a member has engaged in or is likely to engage in any of the following acts, it may, without prior notice, delete posted content, suspend or discontinue the Service, or cancel the member's registration. · Infringing the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of The Five Books, participants, lecturers, or third parties · Using content beyond the intended use of the Service · Acts related to criminal activity or acts contrary to public order and morals · Sending obscene information or information harmful to minors · Acts aimed at meeting members of the opposite sex with whom the member has no acquaintance · Acts violating laws or the internal rules of an industry association · Sending information containing computer viruses or other harmful programs · Acts that may interfere with The Five Books' operation of the Service · Impersonating third parties or allowing third parties to use one's account · Downloading content via software or third-party websites · Any other acts The Five Books deems inappropriate
The Five Books may, at its discretion, change the content of the Service or terminate its provision, and bears no liability for any damages caused to members by such changes or termination. In the event that The Five Books terminates the Service, it will notify members in advance by a prescribed method.
The Five Books may change the content of these Terms when it deems necessary. It will notify members of the changed content in advance or post it on the Service. If a member uses the Service after such notification or posting, or fails to complete the deregistration procedure within the prescribed period, the member is deemed to have agreed to the changes.
Members may withdraw from the Service and cancel their registration by notifying The Five Books through the prescribed method. The handling of personal information after withdrawal shall be governed by Article 8.
The handling of members' personal information by The Five Books shall be governed by the separately established Privacy Policy, and members agree to The Five Books handling their personal information in accordance with that policy. The Five Books may use and disclose information and data provided by members in the form of statistical information that does not identify individuals, at its discretion, for the purposes of service improvement, enhancement, and development.
Members may not assign, transfer, pledge as security, or otherwise dispose of their status under these Terms or any rights or obligations based on these Terms to any third party. If The Five Books transfers its business related to the Service to another company, it may transfer its status, rights, and obligations under these Terms, as well as members' registered information, to the transferee of such business transfer.
These Terms shall be governed by the laws of Japan. In the event of any dispute arising from or relating to these Terms or the Service, the Tokyo District Court shall be the exclusive agreed court of first instance.
